No jail time for damaging car

A P.E.I. man who hit a woman’s car with a baseball bat after getting into an argument in a Burger King parking lot was recently given a suspended sentence and community service.

Coady James Fisher, 22, appeared before Judge John Douglas in provincial court in Charlottet­own for sentencing after previously pleading guilty to damaging property and theft.

Crown attorney Nathan Beck told the court that in July, Fisher went to meet the woman in a Burger King parking lot to get something out of her car.

The two argued, Fisher grabbed a bat from the woman’s car and hit her vehicle with it causing more than $1,000 in damage.

Beck said the police arrested Fisher the next day and released him on an undertakin­g not to have any contact with the woman.

Fisher later sent her a message on Facebook, which included a photo of his promise to appear in court and the undertakin­g.

In a separate incident in June, Fisher and two other people went to the liquor store in Cornwall where they each stole a bottle of liquor.

Fisher took a bottle of rum valued at $15.99.

Douglas fined Fisher $100 for the theft.

With the suspended sentence for damaging property, Fisher will be on probation for one year and must complete 50 hours of community service, although his probation officer has the discretion to reduce the number of hours required.

Fisher must pay $1,067.43 in restitutio­n for the damage to the car and $15.99 for the rum.

Douglas also ordered Fisher to go back to court on Dec. 4 for an update from his probation officer to see if he is complying with the spirit and intent of the probation order.
