Man pulls pellet gun after break-in

A P.E.I. man who broke into a shed and pulled a pellet gun on a witness will be back in court in February for sentencing.

Kyle James Willoughby, 35, recently appeared before Judge Nancy Orr in provincial court in Charlottet­own by video from jail where he has been in custody since his arrest.

Willoughby pleaded guilty to one count of break and enter and commit theft, as well as one count of carrying a weapon for a dangerous purpose.

Crown attorney Nathan Beck told the court that on Nov. 25 at around 10:30 p.m., a witness saw Willoughby going to a neighbouri­ng property. The court heard the witness tried to contact the owner and went over to the property where he found Willoughby near a pile of tools.

Beck said the owner arrived and knew Willoughby, who said he was there to get a drill bit for someone else who knows the owner.

The owner told Willoughby to leave, and Beck said he went to his vehicle where he grabbed a pellet gun.

Beck said a witness grabbed the gun in one hand, Willoughby’s wrist in the other and pinned him against the vehicle.

Willoughby dropped the gun in the vehicle and continued to utter threats, although he didn’t struggle, Beck said.

The court heard Willoughby said that if the gun had been real, the man who grabbed him would be dead.

When the police searched Willoughby, they found two folding knives.

After hearing the facts, Orr requested a pre-sentence report be prepared and she adjourned the matter until Feb. 24 for sentencing.
