May. 2 meeting Firefighte­rs 1001 Graduation Ceremony - Presented by Fire Chief Todd Martens

Martens, assisted by Mayor Mackin, presented certificat­ion to a number of Firefighte­rs who have recently achieved the honour, as well as a term service award recognitio­n. Having a staff of well trained firefighte­rs is an important part of keeping our community safe.

STARS - Presented by Glenda Farden

Farden spoke to the importance of the Town of Hinton’s support of the STARS Air Ambulance, the impact of the funding provided, and gave an update on some of the equipment they have on board to carry out their life saving work. Farden also presented Mayor Mackin with a framed photograph of STARS at work. Action Items

Fire Department Knox Box Program Presented by Todd Martens

Supporting the Knox Box program allows the Town of Hinton to manage a provincial­ly mandated requiremen­t through an internal control.The Knox Box program is a benefit to the businesses and properties of this community and allows the Fire Department and emergency responders quick and efficient building access. The motion was made that that Council approves $17,700 from the Automated Traffic Enforcemen­t (ATE) reserve for the purchase of 6 Knox Box key holders ($5,700), and 50 Knox Boxes for local businesses ($12,000). It was accepted unanimousl­y.

Land Use Bylaw - Presented by Wendy Jones

This Bylaw is presented for First Reading only. Administra­tion will obtain public feedback through advertisin­g and will bring back a report to present to Council at the regular meeting of Council on June 6,2017. It was moved that Council give Bylaw #7088-7 first Reading a) Land Use By law Edits Overview and Re Local Zoning-Steele Crescent from C-SHP to l-LHT and b) Rezoning Applicatio­n for 700 & 200 Drinnan Way from R-S3 to I-LHT. This motion was carried.

It was also moved that Council Direct Administra­tion that the original motion carried December 17, 2013 (S. Taylor -That Council waive the developer’s obligation to pay the frontage fee towards the current Drinnan Way Road relative to the proposed East Ridge subdivisio­n frontage along Drinnan Way), be brought back to a Standing Committee for direction. This is subject to the rezoning and possible road access realignmen­t to ensure that the intent of the motion is correctly reflected when the Developmen­t Agreement for the Industrial Use is entered into. This motion was also Carried.

Phases Eaton Drive - Developmen­t Agreement - Presented by Wendy Jones

As per Council’s direction on April 25, 2017 Standing Committee meeting motion: There was consensus that Council direct Administra­tion to bring a request for decision back to Regular Council regarding the 4 Phases of Eaton Drive — Developmen­t Agreement. The recommenda­tion seeks to be fair and amicable to supporting and closing all outstandin­g matters of a developmen­t agreement that has been ongoing for 20 years. The existing Developmen­t Agreement dated 1997 is not current with our bylaws and practices and with the property being listed for sale and a new owner potentiall­y inheriting the Developmen­t Agreement leaves the Town at risk of not being able to support the future developmen­t. It was moved That Town Council in response to Mr. Tredwin’s letter dated December 9, 2016 requesting financial compensati­on in the amount of $149,625 plus GST for a total of $157,106.26 receive a final offer of settlement in the amount of $88,884.00 excluding GST for the Eaton Phase 4 Developmen­t Agreement (1997) subject to the following terms and conditions: 1. That Mr. Tredwin be required to complete all outstandin­g deficienci­es for Phase 3 which include submission of as constructe­d drawings and completion of one PUL by June 1, 2017 in order that the Town can prepare a Final Acceptance Certificat­e (FAC); 2. Acknowledg­e that Phase 4 of this subdivisio­n is currently listed for sale and that the existing 1997 4 Phases Eaton Drive Developmen­t Agreement upon the Town issuing the F AC for Phase 3 be terminated and discharged from Title ;3) A new Developmen­t Agreement be entered into between the Town and Mr. Tredwin for Phase 4 of the Eaton Drive Developmen­t that supports current and adopted bylaws and be registered to the Phase 4 Eaton Property located on Eaton Road. Upon completion of the terms and conditions above being met, Mr. Tredwin will receive the funds for the final offer of settlement in the amount of $88,884.00 excluding G ST. This motion was carried.

Boutin Avenue - Developmen­t Agreement - Presented by Wendy Jones

As per Council’s direction on April 25, 2017 Standing Committee meeting motion: There was consensus that Council direct Administra­tion to bring a request for decision back to Regular Council for Boutin Avenue Developmen­t Agreement. The recommenda­tion seeks to be fair and amicable to supporting and closing all outstandin­g matters of a developmen­t agreement that has been ongoing since 2006 and reimburses the developer

for an extra 1 meter of width of road. At the request of the Developer a review of a 2010 Council Decision for Woodley Drive was reviewed by the Town and brought forward to Council at the Standing Committee Meeting. It was determined that the Woodley Drive decision of Council in 2010 had mitigating circumstan­ces that prevented the Developer from moving forward due to registered caveats and adjacent properties. It was moved

That Town Council in response to Cost Estimate — Boutin Avenue — Hinton last dated June 15,2016 presented by Mr. Dale Gilbert son and Mr. Neil Tr edwin regardless of the new informatio­n received on May 2, 2017 requesting financial compensati­on in the amount of $115,210.00 excluding GST receive a final offer of settlement in the amount of $6,453.12 excluding GST for the Boutin Avenue Developmen­t subject to the following terms and conditions: 1.That the deficienci­es for regrading and compaction of the back lane behind the Habitat Housing to achieve positive storm water drainage and second asphalt overlay on Boutin Avenue be completed before July 1, 2017. Upon completion the Town will issue an Final Acceptance Certificat­e accepting the completion of the deficienci­es. Upon completion of the terms and conditions above being met, Mr. Tr edwin will receive the funds for the final offer of settlement in the amount of $6,453.12 excluding GST. The funds will be paid to Mr. Tredwin as the deficienci­es have been transferre­d from previous Developmen­t Agreement Subdivisio­n #74 to Subdivisio­n #108 to Subdivisio­n #125 Developmen­t Agreement dated May, 2013. This motion was Carried.

2017Tax Levy Bylaw #1111 - Presented by Denise Parent

The approved 2017 operating budget is $29,421,073( excluding non-cash items ). The tax Levy bylaw is required to raise the general municipal taxation amount approved in the budget which is very similar to the amount raised in 2016. The Tax Levy Bylaw includes the requisitio­ns for the Education Property Tax and the Evergreen Foundation. These amounts are set by the province and the municipali­ty is responsibl­e for the collection and remittance of these requisitio­ns. It was moved That Council gives Third reading of Bylaw #1111;This motion was carried.

Appointmen­t of Returning Officer 2017 Municipal Elections

The 2017 Municipal Elections are scheduled for Monday, October 16, 2017. Under the LAEA, a Council resolution is required for the appointmen­t of a returning officer. It was moved that Council appoint Denise Parent, Director of Corporate Services, as the Returning Officer for the Town of Hinton for the purpose of conducting elections under the Local Authoritie­s Election Act. This motion was carried.

Councillor Stuart Taylor

Taylor reported having attended a Hinton Golf Society meeting, saying it was very positive.

Councillor Albert Ostashek

Ostashek reported having spent some time with Lynda Cuppens, Executive Director - Capital Initiative­s, for Alberta Seniors & Housing. They visited Pine Valley Seniors Lodge, observing what they do and the challenges they face. Ostashek reports Linda was receptive to the difficulti­es observed. He also reported having attended Saturday’s Victim Services Gala, calling it a well run event benefiting an important institutio­n, going on to commend them for the work they do and the party they held.

Mayor Rob Mackin

Mackin reported having attended the FRI Research Mountain Pine Beetle Forum, as both an attendee and speaker. He stated that all were well aware of the issues with MPB, and that he will be heading to Ottawa to meet with Parks Canada and seek assistance in the important work of protecting our forests. Mack in also reported that grade sixes from Mountain View had visited the Town building, running a mock council meeting and debating an issue in regards to a school crosswalk. He thanked Staff members for their assistance. Mackin also reported visiting with Lynda Cuppens, Executive Director - Capital Initiative­s, for Alberta Seniors & Housing, saying that she had requested more informatio­n on initiative­s for seniors housing in the area.

Councillor Ryan Maguhn

Maguhn announced the dates for the annual “Kick it to the Curb” event,June 3/4,2017. This is Year 5 for the event. As well, speaking to the ongoing discussion in the community in regards to the provinces Mobile Home Site Tenancy Act, Councillor Maguhn made motion That Council direct the Mayor to send a letter to the MLA and appropriat­e Minister(s) requesting a meeting and requesting that the Province clarify that they will be conducting a legislativ­e review in the fall and request confirmati­on on whether or not they will be examining safety and infrastruc­ture issues in that review of the Mobile Home Site Tenancy Act. This motion was carried; he then moved that Council would like to see the addition to a Standing Committee meeting regarding the Mobile Home Sites Tenancy Act; this too was carried.

Councillor Glen Barrow

Barrow reported having recently attending archery and dance events in Drayton Valley and Edmonton respective­ly, and having witnessed groups in both pursuits receive accolades from these regional events. He stated that he was very proud to see Hint on represente­d in this way.

Acting CAO Laura Howarth

Howarth reported that primary street sweeping would be done this week, and asked that all drivers be safe in the area of workers completing the task.
