Better enforcemen­t of noise bylaw sought in Niagara-on-the-Lake

Niagara-on-the-Lake staff will be looking into how to improve enforcemen­t of the town’s noise bylaw for outdoor events at wineries and other commercial establishm­ents that apply for permits for these activities.

A motion by Coun. Betty Disero was approved Monday that staff review and report to council how noise from events that disturb residents could be better regulated.

“Both sides are unhappy,” said Lord Mayor Pat Darte, regarding residents annoyed about noise and business owners who get complaints “from the same people over and over”.

“How many decibels are OK?” he asked.

Coun. Jim Collard said that with the new Police Act, officers will not be enforcing municipal bylaws.

“We don’t have (bylaw) people working 24-7,” he said, noting an enforcemen­t review could be expensive for the town.

Community and developmen­t services director Craig Larmour said a new bylaw supervisor has recently been hired and is looking at better enforcemen­t policies to discuss with council.

Coun. Jamie King voted against the motion saying that it could distract council from other business at hand and suggested that it be tabled for further discussion by staff.

“I see this as being a very significan­t effort,” he said. “I think we’re opening a can of worms.”
