Trial dates set in shooting case
A jury trial has been scheduled for 14 days this summer for a 36-year-old man accused of shooting a man at a Water St. rooming house last March.
Julian Graham, of no fixed address, is scheduled to stand trial for charges including attempted murder starting July 30 in Peterborough Superior Court of Justice.
He is next scheduled to return to court June 6 for assignment court, basically an opportunity for prosecutors and defence lawyers to provide an update on their readiness.
Graham appeared before Justice Robert Beninger in Peterborough Ontario Court of Justice for a two-day preliminary hearing – which determines if there is enough evidence for a trial – on Sept. 15 and 18.
A publication ban prohibits publishing any evidence from the preliminary hearing, including information that could identify any witnesses. The accused elected to be tried by a judge and jury after the judge formally committed the case to trial.
The incident happened March 10.
The shooting victim was treated by paramedics and transferred to a Toronto hospital, where his condition improved. The act was not random, police said.
Graham was arrested in the Oshawa area on March 11 with help from Durham Regional Police.
He was initially charged with aggravated assault, pointing a firearm, discharge a restricted/ prohibited firearm with intent, unauthorized possession of a prohibited or restricted firearm, possession of loaded prohibited or restricted firearm, careless use of firearm-weapon, prohibited device or ammunition, and use of a firearm while committing offence, as well as three counts of possession of firearm or ammunition contrary to prohibition order.
The attempted murder charge was added to the list in early April.
