A Dartmouth man will serve federal jail time after being found guilty on three charges stemming from a robbery at the Greenwich Irving Circle K last year.

Following a trial in Kentville provincial court, Deion Malik Brushett, 19, was found guilty on March 1 of using violence toward the clerk to prevent or overcome resistance in stealing money from the store; having his face disguised by a hood and sunglasses with intent to commit an indictable offence; and uttering a death threat.

The matters were adjourned to allow time for a pre-sentence report to be prepared. On July 25, Judge David Ryan sentenced Brushett to 30 months in custody on the robbery charge. Brushett was also sentenced to one year, to be served concurrent­ly, for being disguised with intent to commit an indictable offence; and was sentenced to one year, to be served concurrent­ly, for uttering a death threat.

The court granted a DNA order and imposed a 10-year firearm prohibitio­n against Brushett. He was fined a total of $600 in victim surcharges.

A co-accused, Trevon Domonic Longard, was found not guilty in November 2016 on charges stemming from the robbery.

According to a news release issued by police following the incident, the Kings District RCMP responded to a report of an armed robbery that occurred at the Greenwich Circle K at 4:45 a.m. on May 22, 2016. Two men entered the store and demanded cash. One was armed with a knife.

A struggle ensued between the lone employee on duty and the man brandishin­g a knife. The employee was not injured during the struggle but the man with the knife received minor injuries. The RCMP arrested two suspects a short time later.

Brushett was also sentenced on July 25 to one day in custody on each of two counts of failing to comply with his recognizan­ce in Halifax on July 23. One charge related to a condition that Brushett was not to possess or consume alcohol or non-medically prescribed drugs and the other count related to failing to comply with a house arrest condition.
