Convicted sex offender facing new charges after exposing himself to minor

A Windsor man just released on strict parole conditions is facing a new indecent act charge after allegedly exposing his genitals to a female minor.

Garnett Frederick Smith, 67, is facing two charges — one for committing an indecent act, the other for breach of parole — after he allegedly exposed himself to a minor around 4 p.m. on May 28 as she observed from an adjacent property in Windsor.

He was arrested by RCMP later that day and held in custody overnight. He appeared in Windsor provincial court May 29 to face both charges and was later released on strict conditions.

He is due in court again on June 12. The RCMP has also confirmed the investigat­ion remains ongoing. Smith’s alleged breach of probation relates to the sentence he received after being convicted of several sexrelated charges involving minors in 2016, for which he was handed a 90-day intermitte­nt sentence to be served at Burnside’s Central Nova Scotia Correction­al Facility.

The specific parole condition he breached was to not be in the presence of children under 16 unless they are also in the company of a responsibl­e adult over 18 who is aware of the offender’s circumstan­ces. Smith is to serve parole for three years beginning on his date of release.

His DNA was also submitted to the RCMP’s National DNA Data Bank after his conviction.

The incidents relating to this case occurred in 2014, at which time Smith operated an ice-skate sharpening kiosk at the Hants Exhibition Arena, where he was known as “Gun.”
