Intellectual Property Governance in Cross Border E-Commerce： Dilemma，Causes and Solutions

理主体内部、相互之间以及社会其他参与方多元共同治理。这种多元合作涉及政府、知识产权权利人、知识产权被许可人、知识产权商业使用者、知识产权最终使用者、跨境电商平台、民间力量，不仅可以进行境内合作，还可以跨境合作；不仅可实现共赢，也能起到相互监督、多元化制衡的作用。譬如，通过跨境电商平台之间加强合作，增强各跨境电商平台知识产权交易纠纷处理的统一性；不仅知识产权权利人可以运用民间集体力量加强知识产权管理，跨境电商平台、政府也可以与民间集体力量合作，相互共享资源，汲取力量。注释： ①涉及互联网（Internet）方面知识产权的国际条约，主要有世界知识产权组织（WIPO）制定的《版权条约》（WCT）、

WPPT《表演和录音制品条约》（ ），但参加成员有限。WIPO 2016 12 31

年欧盟的《欧洲电子商务行动方案》、1997年美国政府的《全球电子商务框架》、1998

年经济合作与发展组织（OECD）的《全球电子商务行动计划》，但这些文件约束力小，后续国际社会也一直在努力进行研究和谈判，因现实困难较多，进展缓慢。

Abstract：With the rapid development of internet，cross- border e- commerce has also been developed rapidly. There are some problems with the development of cross-border e-commerce，such as the complicated intellectual property related problems and the governance relate problems. And causes for these problems are the conflict between demand of cross-border e-commerce and the regional protection of intellectual property，conflict between the acceleration of technological innovation and the lagged behind system and the insufficient international coordination，and the conflict between efficiency and fairness. To effectively breakthrough this dilemma and establish the rational intellectual property governance relation for cross-border e-commerce，we should encourage communication among stakeholders，encourage both domestic and international stakeholders to participate governance，strengthen cooperation among all governance main bodies；and，especially，the comparatively vulnerable party in cross- border e- commerce intellectual property relation should improve their strength with the help of such private forces as industrial association，chamber of commerce，and copy right management organizations.
