A court in Wuhan, Hubei Province has awarded 137,700 yuan ($ 22,950) in wages and damages to an auto parts company employee who was fired after being caught sleeping at his desk.
The city court overturned a previous decision from 2015, and ruled that sleeping at work was not grounds for termination according to the company’s regulations, newspaper Chutian Jin Bao reported on Monday.
Zhang Yong was fired after supervisors caught him asleep at his desk during an inspection on June 18, 2015.
An employee at the company for 18 years, Zhang was charged with a “severe violation of discipline,” citing company regulations from 2008.
Zhang argued that he was taking a 5- minute nap after staying up late for the previous four nights on company business, the court heard.
A lower court ruled in the company’s favor.
However, in the latest ruling, the city court found that napping did not qualify as a “severe violation of discipline.”
Zhang was awarded 137,700 yuan in back wages and damages.
Social media relished in Zhang’s vindication.
“Clap for the judge!” posted “xiaobaishoujiwangzhan” on Sina Weibo.
“If these regulations were implemented nationwide, every civil servant would be fired [ within] a year,” wrote “Tears of the Nile.”
