Crime Stop Security takes Hancy Constructi­on to court

MBABANE - Crime Stop Security (Pty) Ltd has filed a notice of motion at the High Court of Eswatini requesting it to direct or authorise Hancy Constructi­on (Pty) Ltd to pay the sum of E288 000 allegedly owed to them.

The\ also reTuested the +igh &ourt of Eswatini to direct or authorise +anc\ &onstructio­n 3t\ Ltd to withhold the pa\ment of sum E187 885.62 or an\ mone\ due and pa\a ble to +anc\ &onstructio­n 3t\ Ltd b\ Eswatini Electricit\ &ompan\ EE& pending the finalisati­on of their matter.

Sums

,n the event that the above men tioned sums have been paid out to +anc\ &onstructio­n 3t\ Ltd, &rime 6top 6ecurit\ 3t\ Ltd want the +igh &ourt of Eswatini to interdict +anc\ &onstructio­n 3t\ Ltd from dissipatin­g the sum of E400 000 from its banN accounts held at 6tandard %anN, to be Nept as securit\ for the claim instituted.

&rime 6top 6ecurit\ 3t\ Ltd are the applicants in the matter, +anc\ &onstructio­n 3t\ Ltd is the 1st re spondent while Eswatini Electricit\ &ompan\ EE& is the 2nd respond ent.The respondent­s in the matter are \et to respond to the allegation­s made b\ the applicant.

The applicant said in 1ovember 2018, the first respondent engaged them for the provision of seven se curit\ guards at 0Nhu]weni site, 0alNerns site and 6iphocosin­i site, sites belonging to +anc\ &onstruc tion 3t\ Ltd.

&rime 6top 6ecurit\ 3t\ Ltd said the service fee was fixed at E3 980 per guard, per month.

“The first respondent breached the terms thereof b\ failing to pa\ us for the services rendered. $s at the 25th 6eptember 2021 the amount due and owing was fixed at E187 885.62,” mentions &rime 6top 6ecurit\ 3t\

Ltd in the founding affidavit.

The applicant said in an attempt to recover the monies owed as at 6ep tember 2021, the\ issued summons under the +igh &ourt of Eswatini.

Summons

The\ said following the summons, a meeting was convened around )ebruar\ 2022 between all parties¶ mentions in the matter.

“+anc\ &onstructio­n 3t\ Ltd then instructed Eswatini Electricit\ &om pan\ EE& to maNe direct pa\ment to us for the sum of E288 000,” said the applicant.

The applicant also mentioned that due to procuremen­t procedures, the\ learned that EE& would not be able to pa\ them directl\ unless it was a court order. &rime 6top 6ecurit\ 3t\ Ltd outlined that, it is on this basis that the\ have approached the +igh &ourt of Eswatini seeNing the order.

The applicant added that to date, the amount owed with regard to securit\ services provided to the first respond ent is E366 984.86.

The applicant also wants the +igh &ourt of Eswatini to withhold the pa\ment of E187 885.62 from EE& to the first respondent pending the finalisati­on of the action proceeding.
