JSC looks to fill judge’s position

MBABANE – The JSC is looking for a candidate to fill the position of a judge of the Supreme Court.

A vacancy was advertised in the media by the -udicial Service Commission (-SC) and the closing date for submitting applicatio­ns was yesterday.

The applicatio­ns, according to the vacancy advertisem­ent, were to be submitted to the secretary of the -SC and they were to be ac companied by the candidate¶s curriculum vitae (CV) and copies of the required qualificat­ion.

Candidates who do not have the required qualificat­ion were advised not to apply as their applicatio­ns would not be considered.

The responsibi­lities of the successful can didate, according to the advertisem­ent, are to preside over court proceeding­s and perform any other duties assigned by the chief justice.

Section 154 of the Constituti­on provides that: (1) A person shall not be appointed as a justice of a superior court unless that person is a person of high moral character and integrity and in the case of an appointmen­t to (a) the Supreme Court, (i) that person is or has been a legal practition­er, barrister or advocate of not less than fifteen years practice in Swa]iland ((swatini) or any part of the Commonweal­th or the Republic of Ireland; or, (ii) that person is, or has served as, a -udge of the +igh Court of Swa]iland or -udge of a superior court of unlimited jurisdicti­on in civil and criminal matters in any part of the Common wealth or the Republic of Ireland for a period of not less than seven years ; or, (iii)that person is, or has served as, such legal practition­er, barrister or advocate as mentioned in paragraph (a) (i), and as such -udge as mentioned in paragraph (a) (ii) for a combined period of that practice and service of not less than fifteen years;

-udges of the Supreme Court are Chief -ustice %heki Maphalala, -udge Stanley Maphalala, -udge Phesheya 'lamini, -udge Majahenkha­ba 'lamini, -udge -acobus An nandale, -udge 1kululeko +lophe, -udge Sabelo Matsebula.

-udge Robert Cloete was reported to have retired on medical grounds but during the course of this week, he was seen in court hear ing matters with other members of the bench.
