SIPHO RE-EXAMINED BY ADVOCATE LAURENCE HODES:

-

ADVOCATE LAURENCE HODES: Was there anything that the witnesses were afraid of from you?

SIPHO SHONGWE: When I listened to the audio and what was transcribed, they had no fear. They sounded happy and were proposing love to Futhi (Masuku). Ncaza was relaxed.

ADVOCATE: How well was your arrest known?

SHONGWE: We live in times where information moves quickly. Front pages of newspapers carried my stories for weeks. The whole world knew about my arrest.

ADVOCATE: Was it explained why they (Ncaza and Tata) needed you?

SHONGWE: It was not. Nkosi is heard asking what has Sipho done (Wenzeni uSipho)?

ADVOCATE: Did Futhi know you at the time?

SHONGWE: I got to know about Futhi here in court.

ADVOCATE: You don’t dispute the appearance of Ncaza, Tata and Dzodzo in the videos at Galp, Ezuwlini Superspar and Oshoek Border Gate.

SHONGWE: I don’t.

ADVOCATE: is there a reason in your mind to dispute what was captured on video?

SHONGWE: I cannot dispute it.

ADVOCATE: The 2016 incident at Royal Swazi Police Station, was it recorded in any possible way? Was it official?

SHONGWE: It was recorded. I recall that it was recorded in the OB (Occurrence Book) and minutes were recorded by a certain woman.

ADVOCATE: Subsequent to that, if something happened to Gamedze, who would fingers be pointed at you?

SHONGWE: My Lord, I don’t think they would point at me because the issue we had was resolved.

ADVOCATE: When you were arrested, were the call records available?

SHONGWE: I was never showed any. We were shown dates of when they were extracted.

ADVOCATE: Regarding the phone numbers, does it appear who the callers were?

SHONGWE: The (MTN) expert said it was impossible.

ADVOCATE: They said two phones were using the Lwandle Farm tower; how many phones were using the tower at the same time?

SHONGWE: Lwandle has a radius of 10km and there are many homesteads and people there.

ADVOCATE: Two numbers, one for V-Trac and another attributed to you, are said to be seen moving together. Do you know how many other numbers move together?

SHONGWE: If you travel from my home to Manzini, a lot of people move to and from work in the morning and evening. It’s common cause that people start work at 8am and knock-off at 5pm. It’s possible to see one and the same people and cars going to and from work. I left.

ADVOCATE: Advocate Hellens said the cellphone numbers followed each other as a wife and husband would do. Were you always together with your wife?

SHONGWE: I stay with her but I travel a lot.

ADVOCATE: You requested the occurence book (OB) during the pre-trial, why did you require it?

SHONGWE: I wanted to show the court that there was no bad blood between me and Gamedze. I wanted the court to have documented evidence.

ADVOCATE: 7802 5449 belongs to who?

SHONGWE: It’s a contract number belonging to V-Trac.

ADVOCATE: Did you change the SIM card in your phone?

SHONGWE: I had one Nokia phone which is now lost. I had no other phone to change to.

SHONGWE: Did you speak to Ncaza on January 11, 2018?

SHONGWE: No.
