MBABANE – Incarcerat­ed Gawuzela’s son Zweli Simelane is demanding the release of the cartridges that were seized by the police upon his and co-accused’s arrest.

=weli told the &rown that he intends to engage a ballistic expert for assessment of the cartridges.

+e was arrested on March , 2023, together with Economic Freedom Fight ers EFF Swaziland member Siphosethu Malinga and Mxolisi Jabulani Simelane, who is a member of Swaziland /ibera tion Movement S:$/IM2 .

They face three counts of allegedly contraveni­ng the Suppressio­n of Terror ism $ct, 2008, two of robbery and one of contraveni­ng the Passport $ct of 1 71.

During their appearance for a remand hearing on March 17, 2023, the trio demanded the release of their seized cellphones to their possession.

The &rown obtained an order on March 13, 2023 to detain the items that were allegedly found in the accused persons¶ possession.

The accused persons filed a notice to raise points of law for the court to issue an order dischargin­g the detention order. :hen the matter was adMourned on March 17, 2023, the &rown was expected to file its opposing papers on March 22, 2023.

In a letter addressed to the director of public prosecutio­ns DPP , /awyer /ucky +owe told the &rown that

“:e are advised that under your sup posed charge sheet, there are certain cartridges which were found with regard the first accused Malinga , which in effect you are implicatin­g the third accused =weli in that regard, unless we are misunderst­anding the charge.

“If that is the position, please kindly let us have three of the said cartridges in order for us to send them off to a ballistic expert to assess and advise on the calibre of bullet and which gun was used in that regard.´

Entitled

+e said in terms of Section 21 of the &onstitutio­n, they were entitled to prepare adeTuately for their defence and in that regard stated that the car tridges were part of their preparatio­ns for their defence, accordingl­y.

+e further wrote that they wanted to have the cartridges by March 2 , 2023.

“If you have any difficulty, our Mr +owe would be available to attend to the same and collection of the same for onward transmissi­on to our ballis

Ehhini Inner &ouncil. $s a result, the inner council is said to have promptly attended to the matter. It has been gathered that the inner council observed during the inspection in loco that Shongwe had exceeded his boundaries. It is said that the inner council ordered Shongwe to stick to his boundary and further warned him against provoking his neighbour.

Revenge

+owever, it is alleged that Shongwe organised some boys of the area to help him revenge on Phinda shortly after the verdict by the inner council. It had been gathered that Shongwe and the boys invaded his neighbour¶s homestead in search of Phinda at around 4pm. Shongwe and the boys allegedly returned to Phinda¶s home stead at around pm and smashed window panes and damaged some household items, including a tele vision set.

It has been gathered that the in vasion and attack, as well as the malicious damage to property, was reported to the police who swiftly attended to the scene.

Shongwe 45 was subseTuent­ly arrested together with the four men whom he allegedly organised to assist him in fighting Phinda. +is co accused are %oyzie 1caba .unene 27 , /inda Mkhiza 26 , Sizo Skap pie Siyaya 33 and Sihle Mapopo Simelane 23 , all from Mvutshini.
