Patient sues Good Shepherd Hospital E1.7m

MBABANE - A woman from Dvokolwako is demanding E1.7 million from Good Shepherd Mission Hospital.

Ayanda Magagula claims that a doctor from the hospital allegedly left a foreign object inside her womb, after assisting her to give birth through caesarean section.

Caesarean section, C-section or caesarean birth is the surgical delivery of a baby through a cut (incision) made in the mother’s abdomen and uterus. Healthcare providers use it when they believe it is safer for the mother, the baby or both.

In her particular­s of claim, the plaintiff (Magagula) submitted that on January 9, 2020, she was admitted for an operation to the defendant’s (Good Shepherd Mission Hospital), specifical­ly for a caesarean section, to give birth to her child, She alleged that she was attended by Dr Korshy, who was working within the course and scope of his employment with the defendant.

Establishm­ent

She narrated to the court that upon giving birth, she was admitted to the defendant’s establishm­ent for a further four days. The plaintiff brought it to the court’s attention that, upon delivering her child, she felt abdominal discomfort, abdominal pressures and pain inside her body’s internal organs as if there was a foreign object. Magagula said she alerted the defendant’s medical personnel, who were attending to her, but she was told that there was no foreign object the doctors were seeing inside her womb.

According to the plaintiff, the abdominal discomfort, abdominal pressures and pain continued even after she was discharged from the hospital. She highlighte­d that after she was discharged from the hospital and still feeling the abdominal discomfort, abdominal pressures and pain, inside her body’s internal organs as if there was an object, she returned to the hospital (Good Shepherd) more than once for checkups.

She alleged that at the hospital, tests were conducted and she was advised that her abdomen and womb were normal and there was no foreign object. She averred that despite the tests at the defendant’s establishm­ent, she continued to feel abdominal discomfort, abdominal pressures, pain and presence of a foreign object inside her womb. Magagula stated due to the continued abdominal discomfort, abdominal pressures and pain, in June 2020, she decided to go to Women and Children Hospital to seek medical help on the abdominal discomfort, abdominal pressures, pain and presence of a foreign object she was feeling in her womb.These are allegation­s contained

in particular­s of claim whose veracity is still to be tested in court and the defendant is yet to file its papers.

“As a consequenc­e of the medical tests that were conducted at Women and Children Hospital, a foreign object was detected in my womb, I then took the results back to the defendant whereupon the defendant performed another surgery to remove the foreign object, which was indeed removed,” submitted the plaintiff. She informed the court that to date, she suffered adverse effects, which included; severe pain in her abdomen, which was aggravated by cold weather and excruciati­ng pain in her abdomen when she stands for too long.

“Plaintiff has, as a result of the negligence and wrongful operation carried out by the defendant, that left a foreign object in her womb, plaintiff suffered damages in the sum of E1 764 364,” reads part of the plaintiff’s particular­s of claim. The matter is still pending in court and appearing for the plaintiff are lawyers from S.V Attorneys in Mbabane.
