Shylock takes 6 to Small Claims Court

MANZINI – A money lender has filed claims against six debtors in the Small Claims Court.

Fundukuwel­a Anxious Gamedze from Matsapha, who is employed at Southern Star, accused the debtors of defaulting on loans ranging from E500 to E3 500.

The loans were made between last year and this year, and the lender was seeking repayment.

Gamedze told the court that he was owed E2 000, which was loaned to Sibusiso Magagula (defendant) on or about May last year.

The plaintiff (Gamedze) narrated that the defendant requested a loan of E2 000 at 20 per cent interest, but failed to pay as per the agreement.

He said he was no longer pursuing the interest, but wanted the principal debt. Gamedze also prayed for costs (for sheriff or messenger).

After having read the matter, the court ordered the defendant to pay the plaintiff the sum of E2 000 by way of instalment­s of E500 per month from on or before the end of this month.

In addition, he was ordered to pay costs in the sum of E500.

Interest

In another matter, Gamedze submitted that on or about May 2023, he was approached by Ntshontsho Zwane, who requested a loan of E600 at 20 per cent monthly interest.

He said the defendant failed to repay the money. The money lender prayed that the defendant should pay the principal debt of E600 with costs.

The court ordered the defendant to pay the plaintiff the sum of E600 on or before the end of February 2024.

The defendant was further ordered to pay costs in the sum of E500 on or before the end of March 2024.

The Small Claims Court adjudicate­s over matters of up to E20 000.
