MBABANE – Entities in different sectors will be expected to fork out between E500 and E3 000 as registrati­on for their data collectors and processors.

The decision taken reflects that a once-off registrati­on shall be payable by each entity under different categories, which will be determined by annual turnover.

Besides the registrati­on fee, the entities will be expected to pay an annual renewal fee ranging between E5 000 and E30 000.

A table detailing the payments reflects that a Category A entity is one whose annual turnover does not exceed E500 000.

Such an entity, it is reflected, will be expected pay the lowest registrati­on fee, which is E500.

It is stated in the document that the fees prescribed in the decision are based on a number of considerat­ions. The considerat­ions include the annual turnover for private and stateowned entities. Also considered is whether an entity is a public or government ministry. Another considerat­ion is whether an entity is non-profit making or is a religious institutio­n.

DATA CONTROLLER­S

It is mentioned that government ministries shall register as data controller­s and pay registrati­on and annual renewal fees in accordance with the categories outlined above on behalf of their respective department­s that process personal informatio­n.

“All public enterprise­s who in their line of business process personal data shall be required to register as a data controller or a data processor and pay registrati­on fees and annual renewal fees

in accordance with the categories stated,” it is highlighte­d.

Also mentioned in the decision, is that schools that process personal informatio­n and some others fall within sensitive data, as defined by the Act.

As a result, the decision provides that the Ministry for Education and Training shall be registered as a data controller for government schools and pay the registrati­on fees payable by ministries.

On the other hand, private schools shall pay registrati­on fees and annual renewal fees in accordance with the categories stated.

Regarding institutio­ns of higher education, it is mentioned that they fall within the ambit of the Act and shall be registered as data processors or controller­s and pay registrati­on fees and annual renewal fees in accordance with the services including government hospitals and clinics.
