MBABANE – Entities in different sectors will be expected to fork out between E500 and E3 000 as registration for their data collectors and processors.
The decision taken reflects that a once-off registration shall be payable by each entity under different categories, which will be determined by annual turnover.
Besides the registration fee, the entities will be expected to pay an annual renewal fee ranging between E5 000 and E30 000.
A table detailing the payments reflects that a Category A entity is one whose annual turnover does not exceed E500 000.
Such an entity, it is reflected, will be expected pay the lowest registration fee, which is E500.
It is stated in the document that the fees prescribed in the decision are based on a number of considerations. The considerations include the annual turnover for private and stateowned entities. Also considered is whether an entity is a public or government ministry. Another consideration is whether an entity is non-profit making or is a religious institution.
DATA CONTROLLERS
It is mentioned that government ministries shall register as data controllers and pay registration and annual renewal fees in accordance with the categories outlined above on behalf of their respective departments that process personal information.
“All public enterprises who in their line of business process personal data shall be required to register as a data controller or a data processor and pay registration fees and annual renewal fees
in accordance with the categories stated,” it is highlighted.
Also mentioned in the decision, is that schools that process personal information and some others fall within sensitive data, as defined by the Act.
As a result, the decision provides that the Ministry for Education and Training shall be registered as a data controller for government schools and pay the registration fees payable by ministries.
On the other hand, private schools shall pay registration fees and annual renewal fees in accordance with the categories stated.
Regarding institutions of higher education, it is mentioned that they fall within the ambit of the Act and shall be registered as data processors or controllers and pay registration fees and annual renewal fees in accordance with the services including government hospitals and clinics.
