MBABANE – A 24-year-old man of Nkoyoyo, under Chief Zembe, has been arrested for the murder of a Mozambican national.

0pendulo Trevor Ngcamphala­la is alleged to have killed $rmando Tito 3auke by stabbing him all over his body with a sharp obMect. $s per the charge sheet, 3auke succumbed to the inMuries.

:hen appearing before $cting 0agistrate Inno cent 0otsa, his right to legal representa­tion was explained to him and he elected to conduct his own defence. He is alleged to have committed the offence on February 17, 2024, at Nkoyoyo.

$n applicatio­n was later moved by the &rown to have the accused person¶s blood specimen taken, for purposes of further investigat­ions, which was later granted by 0agistrate 0otsa. The applicatio­n was moved in terms of Section 342 bis 1 of the &riminal 3rocedure and Evidence $ct of 1 38.

Blood

The order states that the accused person is expect ed to comply in the entire process of the production of blood specimen without any reasonable excuse.

It also states that failure for him to comply as per the order would result in him facing prosecutio­n in terms of Sub section 2 of the aforementi­oned $ct.

The $ct also states that, in case an accused person is convicted of failure to comply with the order compelling the production of blood specimen, the accused would be liable to a fine not exceeding E10 000 or imprisonme­nt not exceeding five years or both.

The accused person did not obMect to the &rown¶s applicatio­n of having his blood specimen taken from him for the purpose of further investigat­ions.

The accused person was later remanded in custo dy until 0arch 1, 2024, pending committal to the High &ourt. 0otsa then advised the accused person to move his bail applicatio­n at the High &ourt if he intended to do so.

MBABANE –“Exodus 20 verse 12 says, honour your father and your mother, so that you may live long in the land the Lord your God is giving you.”

This biblical verse was shared by 0babane $cting 0agistrate Innocent 0otsa before sentencing Banele µBoy]¶ Dlamini 37 of 0an]ana, whom he had found guilty and convicted of assaulting his biological mother with open hands once on the face.

For assaulting his mother, Dlamini was facing a charge under the Sexual Offences and Domestic 9iolence SOD9 $ct No.15 of 2018. He is said to have committed the offence on December 27, 2023, while at 0an]ana, 0babane.

In sentencing Dlamini, the acting magistrate highlighte­d that he was of the view that the former must be sentenced and further allowed to spend time in Mail for such be haviour.

³The accused must receive a cus todial sentence for all his wrongs and I Must hope that he will come out a changed person. Spending time in Mail will make you think twice before you act,´ said 0otsa.

The acting magistrate said he was not in any way going to sit and watch children assault their parents. He said ³that will happen over my dead body.´

0otsa later sentenced Dlamini to four years in prison without an option to pay a fine.

The court then advised him to move an applicatio­n for a review at the High &ourt within 14 days in the event he was discontent with the ruling.

Dlamini then raised his hand and when he was afforded the opportu nity to talk, he said he was wanted know what he was supposed to do regarding his psychiatri­c medica tion, since he would be in Mail for a lengthy period.

In response, 0otsa said he did not care about his condition. He said his act of assaulting his mother annoyed him the most.
