+e argued that he had been in lawful peaceful and undisturbe­d possession of the house and be lieYed that his depriYatio­n of their mother¶s house was unlawful and without his consent or due legal process.

Police

+e said he reported this matter to Malkerns police who recorded a statement. “The report did not yield any positiYe results. The police did not assist me to regain the house and all my personal belongings including my clothes up to the date of this applicatio­n.´

/ucky told the court that on )ebruary Mdudu]i allegedly returned to the home stead for the second time and ordered him out of their mother¶s house. +e alleged that Mdudu]i locked him out of the house and homestead.

“The first respondent locked me out of the house and homestead without a court order. The latter further changed all the house and gate locks. , ran away in fear for my dear life and went to the Malkerns 3olice 6tation for the second time.

Eviction

+e submitted that he had a clear right to an order interdicti­ng Mdu du]i and his cohorts from interfer ing in his right to bury his mother and the spoliation was uncalled for arbitrary illegal unconstitu tional unfair and unMust.

According to /ucky his elder brother was allegedly irresponsi bly trying to deny him the right to oYersee the burial of their mother at her homestead with ulterior motiYes and unMustifia­ble inter ference.

Morals

+e submitted that Mdudu]i¶s conduct lacked good morals of society in that he did not want their mother to be buried with dig nity at her own homestead. /ucky is represente­d by /eo 1dYuna 'lamini of /.1. 'lamini and Associates. The matter is pending before -udge Masuku.
