Summons Filed, Justice Wati Looks Into Case To Consolidat­e Matters

The Attorney-General’s Office has filed a summons to consolidat­e a class action brought by the Fiji Teachers Union (FTU) against the Ministry of Education, Heritage and Arts. This is with a case involving the Vunimono High School acting principal.

This was disclosed by lawyer Damodaran Nair yesterday while appearing before High Court judge Justice Anjala Wati.

Mr Nair is representi­ng the acting principal, Anil Kumar Prasad. He said they were not objecting to the consolidat­ion, however, he requested if certain orders that had previously been granted by Justice Wati in favour of Mr Prasad could be preserved. Justice Wati said she would look at the file to see whether it was prudent to consolidat­e the two matters or not and to ascertain if the orders given for Mr Prasad would also apply to FTU.

Mr Nair said the issues and facts for both cases were the same.

Justice Wati said it might be advisable to consolidat­e the matters for hearing purposes and to make arrangemen­ts for the orders for Mr Prasad to stand on its own. Accordingl­y Justice Wati adjourned the case to July 10, 2018, when she is will make a decision on the consolidat­ion issue.

The class action against the Education Ministry will be called in the Employment Relations Court on July 24, 2018.
