Man gets 8 years in jail for rape of partner

Aman was sentenced yesterday for the violent rape of his de facto partner in August 2020.

The 47-year-old offender was found guilty and convicted for one count of rape of the victim who was his de facto partner and was between 17 and 20 years old at the time of the offence.

Upon the cessation of their de facto status, the offender invited the victim and took her back to his house where the offence took place.

On the considerat­ion of the totality of the evidence, the court saw that the offender and perhaps the victim used some kind of intoxicant substance and at the point of the beginning of the offence, he may have not been in a proper mindset.

High Court Judge Justice Gihan Kulatunga said this was a voluntary situation and that was no excuse, however in these circumstan­ces the offender caused an serious injury to the victim.

The Judge said this was certainly without the victim’s consent.

The Judge told the offender: “You have certainly acted in a cruel manner and after the incident he appears to have locked the house and left the victim and gone away.” He said the offender took advantage of the victim’s vulnerabil­ity and naivety and sexually exploited the victim when she was asleep and weak.

The Judge told the offender: “You violated her body and had no regard for her health and safety. “You caused serious injury to her and caused untold misery to her.” The court sentenced the man to eight years imprisonme­nt with a non-parole period of six years. Having considered the remand period, the remaining period left to be served is seven years imprisonme­nt with a non-parole period of five years.
