Murder Accused to Apply for Bail at High Court
A48-year-old man, charged with the murder of his 77-year-old father, will remain in remand and can apply for bail application once his case is transferred to the high court. Ashish Sen appeared before Magistrate Joseph Daurewa at the Sigatoka Magistrate’s Court yesterday.
Sen was represented by Iqbal Khan while Sergeant Elina Ciri represented Police prosecution. Sergeant Ciri told the court the reasons for objection to bail was that the matter could only be tried in the high court.
The court heard that the accused had allegedly initially discovered his father lying motionless with visible injuries at their Bara Settlement home earlier this month. The court also heard that the accused used to live overseas and recently moved to live with his father.
“Violence occurred in this matter,” Sergeant Ciri said.
“It is cold blooded murder. If released on bail he is likely to interfere with state witness, the nextdoor tenants as police seeks public assistance.”
Mr Khan told the court that prosecution had listed various claims but provided no evidence to rebut in court.
He said his client had no previous conviction, was ready with two sureties, was willing to relocate to Lomawai and visit Vatudradra Police
Post on any day of the week. Magistrate Daurewa told the court that the matter involved domestic
violence and would have to be transferred to high court adding that the defence should file formal
ball application at the high court. The matter was adjourned to March 21 at the High Court in Lautoka
for mention.
