Ramps no longer pursuing costs against gov’t

Ramps Logistics Guyana Inc., is no longer pursuing its claim for costs in the case it won against Government which was ordered by a Court to award the company its local content certificat­e.

When the matter came up for report before acting Chief Justice Roxane George SC yesterday morning, attorney for Ramps Logistics, Ron Motilall, informed that the company would be discontinu­ing its claim for cost.

Solicitor General Nigel Hawke, affirmed that that was indeed the course taken by the parties.

No further details were given by either side.

In the circumstan­ces, the Chief Justice noted that with no orders having to be made as to costs, that final issue which had been outstandin­g, is now settled.

Finding that Ramps Logistics had satisfied every requiremen­t of the Local Content Act, the Chief Justice in a ruling delivered on November 11th last, ordered Head of the Local Content Secretaria­t, Martin Pertab, to ensure that the company was issued its Certificat­e of Registrati­on.

Ramps had withdrawn its claim for damages, but remained resolute that it would be pursuing costs against the Government.

At a hearing last month, Motilall was firm in pointing out that the company will be pursuing that claim.

Hawke had said, however, that government “is always open to trying to find ways of not litigating these matters” and against that background had begged the Court for an opportunit­y where both sides could again look at the issue with what he described as “greater measure of compro mise” in a bid to arrive at a amicable resolution.

Background

In keeping with Justic George’s ruling, Governmen issued the Certificat­e t Ramps.

Ramps had moved to th Court for judicial review seek ing a number of declaratio­ns among them that the decisio of the Minister of Natura Resources and/or th Secretaria­t on June 8th 202 refusing to grant the certifica tion was unlawful.

Ramps which consider itself a Guyanese compan since it is registered here an has been in existence sinc 2013, argued that it was enti tled to be issued a certificat of registrati­on and to b entered into the Local Conten Register in accordance wit Section 6 of the Local Conten Act.

In her ruling, the Chie Justice found that Ramp Logistics had satisfied ever requiremen­t of the Loca Content Act and made th order for the company to b granted certificat­ion.

The Chief Justice had sai that both the Minister and th Secretaria­t had breached th Act. In fact she made it clea that “the Minister had, and ha no authority under the Loca Content Act, to grant or refus certificat­ion.”

Further, she said that th Secretaria­t misconstru­ed th Act and had taken irrelevan factors into considerat­ion such as pending crimina charges against the compan which she said had “absolute ly” no bearing on the determi nation of whether certificat­io should be granted or not.

Blessed to see her 5th generation, she is a mother of 10, a grandmothe­r of 36, and great grandmothe­r of 15, the police said in a release.

Despite being 100, she is fiercely independen­t and takes pride in catering to her every need.

More than ever, she still enjoys preparing all her meals and taking care of herself and her home, the police said.

Lambert also enjoys giving advice and guidance, and she’s known for her charitable contributi­ons in her community. Those lucky to have met her, are usually impressed by her sharp memory as she can still recall the tiniest of details from her childhood.

Lambert’s family members are grateful that she remains in good health. “She has a fighting spirit, and does not allow her age to slow her down”, one family member told the police.

Her advice is, “to live a decent and honest life, and love people just as you love yourself.”

She expressed thanks to her family and friends who she said have always shown her love throughout the years.
