No two MRPs for same pack­aged item

G) Ad­min­is­tra­tive con­trol varies: There is ab­sence of clar­ity with re­gard to the ex­er­cise of ad­min­is­tra­tive and dis­ci­plinary con­trol mainly be­cause the prin­ci­ples of gov­ern­ing the func­tion­ing of the district fora dif­fer from state to state.

The Supreme Court crit­i­cism was pointed and clear, and it passed spe­cific order on each of these points. It has di­rected the union govern­ment to frame model rules for adop­tion by the state gov­ern­ments for the pur­pose of en­sur­ing uni­for­mity in ap­point­ments. The rules shall be framed within four months and submitted in the court for ap­proval. The model rules shall pro­vide: ob­jec­tive norms for im­ple­ment­ing the pro­vi­sions of Sec­tion 10 (1) (b), Sec­tion 16 (1) (b) and Sec­tion 20 (1) (b) with re­gard to the ap­point­ment of mem­bers of district fora, state com­mis­sions and Na­tional Com­mis­sion guide­lines for pay­ment of salary, al­lowances and con­di­tions of ser­vice com­men­su­rate with the na­ture of ad­ju­di­ca­tory du­ties and keep­ing in mind the need to at­tract suit­able tal­ent to the ad­ju­di­cat­ing bod­ies. These rules shall be fi­nalised upon due con­sul­ta­tion with the pres­i­dent of the Na­tional Con­sumer Dis­putes Re­dres­sal Com­mis­sion The court also re­quested the Na­tional Con­sumer Dis­putes Re­dres­sal Com­mis­sion to for­mu­late reg­u­la­tions un­der Sec­tion 30A, with the pre­vi­ous ap­proval of the cen­tral govern­ment, within a pe­riod of three months in order to ef­fec­tu­ate the power of ad­min­is­tra­tive con­trol vested in the Na­tional Com­mis­sion over the state com­mis­sions un­der Sec­tion 24 (B) (1) (iii), and in re­spect of the ad­min­is­tra­tive con­trol of the state com­mis­sions over the district fora un­der Sec­tion 24 (B) (2). These rules will then be sent to the state gov­ern­ments for adop­tion in three months.

There can­not be two max­i­mum re­tail prices (MRPs) for the same pack­aged item within a state, the con­sumer af­fairs de­part­ment has said in its ad­vi­sory to state gov­ern­ments. So, in ad­di­tion to bot­tled water, no pack­aged items, in­clud­ing bev­er­ages, can be sold at two dif­fer­ent MRPs in shops, mul­ti­plexes, or air­ports.
