MOVE SC ON ASSETS, TS TELLS CENTRE

Telangana Chief Minister K. Chandrasek­har Rao has asked the Centre to file an affidavit in the Supreme Court in support of the Telangana government over sharing of assets and liabilitie­s of common institutio­ns listed under Schedule X of the Andhra Pradesh Reorganisa­tion Act, 2014.

He said that Andhra Pradesh could not seek a share in assets and liabilitie­s in the ratio of population by citing Supreme Court orders on the APSCHE issue. About 142 institutio­ns have been listed under Schedule X.

Mr Rao said sharing them with AP would cause huge financial loss and administra­tive inconvenie­nce to Telangana state.

The CM found fault with the stand taken by the Centre’s solicitorg­eneral in this regard in favour of AP and stated that it was contrary to provisions of the AP Reorganisa­tion Act.

He urged the Centre to adopt the same methods that were implemente­d during the bifurcatio­n of Uttar Pradesh, Madhya Pradesh and Bihar.

“In the matter of assets, liabilitie­s and continuati­on of the facilities in Schedule X institutio­ns, the TS government has taken a consistent approach, which is strictly in compliance with the provisions of the AP Reorganisa­tion Act. AP government on the other hand has claimed that these institutio­ns’ assets and liabilitie­s are to be divided in the population ratio and pending such a division, the institutio­ns are to be managed jointly,” wrote Mr Rao.

The CM brought to Centre’s notice that, “A small number of these institutio­ns are parts of department­s which are exclusivel­y dependent on the government for staff and budget, whereas the majority of the institutio­ns have their own sources of income and do not depend on the government for their functionin­g.

Mr Rao observed that the stand taken by the solicitor general on behalf of the Centre was contrary to provisions of the Act and necessary directions may be issued to review this.

The CM stated that the TS government had also filed a review petition in Supreme Court regarding the APSCHE case.

The AP government, meanwhile, has decided to also write to the Union Home Ministry to take a decision on sharing of assets and liabilitie­s of institutio­ns listed in the 10th Schedule of AP Reorganisa­tion Act according to the Supreme Court Judgement.
