HC REFUSES TO QUASH CASE ON EASYMOVIES

The Hyderabad High Court has refused to quash the cases registered against Behind Basika Infotech Pvt Ltd (Easy Movies) by the Saidabad police in 2009 for selling the cinema tickets selling tickets on higher prices through online system.

Justice N. Balayogi was dismissing the petition moved by the Basika Infotech Pvt Ltd seeking to quash the case registered against it for the offences punishable under Section 9 (A) of the AP Cinema (Regulation­s) Act, 1955, and Sections 188, 420, 120-B, 109 read with Section 34 of IPC based on a complaint lodged by G.L. Narasimha Rao an advocate of the city.

The complainan­t alleged that he purchased cinema tickets on line on May 23, 2009 through Easy Movies and they had collected `58.02 per each ticket instead of `50 per ticket and when he questioned about permission to sell tickets at higher rates, the representa­tive of the Easy Movies questioned his authority and replied that it was for the licensing authority to question the method of selling tickets on higher prices through online.

After verifying the facts the Judge Balayogi said, “I am of the considered view that there are specific acts attributed against the petitioner and sufficient material is there to prosecute the petitioner for the alleged offences.

“There is nothing in the petition to suggest that lodging of the complaint against it would be abuse of process of the court and no prejudice is caused to the petitioner therefore.”
