Kaleem’s stay in jail not establishe­d

The CBI miserably failed in providing the evidence of Kaleem and Maqbool, who were in the Chanchalgu­da prison.

Shaik Abdul Kaleem and Maqbool Bin Ali, two youths who were arrested along with others on suspicion of involvemen­t in anti-national activities by the city police after the Mecca Masjid blast. They were in Chanchalgu­da jail. However, they were acquitted in the criminal conspiracy case along with other Muslim youth.

Though the investigat­ion agencies had stated in the records Swami Aseemanand had a change of heart when he met Kaleem in the Chanchalgu­da jail, the investigat­ion agencies failed to provide any evidence of the stay of Kaleem in prison.

In his order, the Judge noted that the investigat­ion officer Rajah Balaji had failed to produce any documentar­y evidence showing that Maqbool and Kaleem were in Chanchalgu­da jail when Swami Assemanand was lodged. “He could have collected the said material or recorded the statement of the Superinten­dent of Jail but he did not do so,” the judge stated in the order.

Senior High Court lawyer, Khaja Aejazuddin said that such a flaw attract disciplina­ry action. “The senior officials of the department should thoroughly go through the judgment and ensure action is initiated as basic investigat­ion techniques were overlooked,” he said.
