HC FAULTS HMDA FOR CAN­CELLING REG­IS­TRA­TION

The Hy­der­abad High Court has faulted the HMDA for can­celling the reg­is­tra­tion of land in favour of Alexan­dra Health City Hy­der­abad Pvt. Ltd.

A di­vi­sion bench com­pris­ing Act­ing Chief Jus­tice Ramesh Ran­ganathan and Jus­tice J. Uma Devi dis­missed an ap­peal filed by the HMDA to up­hold the or­der of a sin­gle judge.

Alexan­dra Health City told the court that it had pur­chased 5 acres at Khanamet near Hitec City in 2008 and paid `10 crore. The HMDA had reg­is­tered the land in its name. It said that in 2012, the HMDA com­mis­sioner is­sued or­ders can­celling the reg­is­tra­tion. It moved the High Court which faulted the ac­tion of the HMDA and set aside the can­cel­la­tion or­ders.

Ques­tion­ing the HMDA for can­celling the sale deed once the sale con­sid­er­a­tion was ful­filled, the bench re­fused to in­ter­vene in the or­der of the sin­gle judge.
