HC THROWS OUT PLEA AGAINST EARLY POLLS

The Hyderabad High Court on Wednesday refused to entertain a PIL seeking to declare the action of the Union of India, Election Commission of India, and the Telangana government in trying to conduct the elections of the Telangana State Assembly before tenure of five years as illegal.

A division bench comprising Chief Justice Thottathil B. Radhakrishnan and Justice S.V. Bhatt, while dismissing the PIL by advocate Rapolu Bhaskar, told the petitioner not to use the court as a platform to clarify his doubts.

The bench said the court would not involve in the affairs of the EC which is a constitutional body and they will not assume that the EC will act on someone’s direction.

The petitioner said that the EC is trying to issue the notification and he filed the plea before the issuance of the notification as the courts will not intervene once the election notification was issued.

The bench asked the petitioner to show if there were any violations in the notification issued by the Governor dissolving the Assembly on the request of the Cabinet and also the affairs of the EC so far on this issue.

The bench made it clear that the court would intervene only when the petitioner shows any specific violation of the Constitution by the EC.

The court said it would not overrule the functions of the EC which is a constitutional body and it will not concerned whether the elections of Telangana to be held along with other states or not.

While dismissing the petition, the bench said that there was no valid reason in the case which warranted the interference of the court.
