HC ADJUDICATES PLEAS ON LAND WORTH `6K CR
Plot owners from Bhagyanagar Housing Co-operative Society submitted to the High Court that the state government was acting contrary to its earlier contentions on the land at Survey No. 1007, situated between Kukatpally and Hitec City, admeasuring 119 acres, and valued at nearly `6,000 crore.
On Thursday, through their Counsel, the plot owners submitted that the stand of the government to register the said land in favour of private parties was contrary to the contention of Special Chief Secretary of Telangana State and in violation of the statutory obligation under Section 22A of the Registration Act 1908.
A division bench, comprising Chief Justice Raghavendra Singh Chauhan and Justice A. Abhishek Reddy, was dealing with three appeals filed by Prime Properties, Sri Siddharth Infratech and Services Limited and ACE HIBC Private Limited, who challenged the order of the single judge, who directed the registration department not to register land in favour of anyone till the title dispute pending before a civil court over this land was adjudicated.
When Prime Properties tried to register the land in favour of third parties and presented the document to the registration department, Kukatpally subregistrar earlier, kept them pending.
The single judge found fault with the sub-registrar of Kukatpally saying that even receiving documents for registration from this company is unlawful because the company failed to file any declaration as required under law.
