HC DISMISSES CLAIMS OVER HMDA LAND
The Telangana High Court on Wednesday dismissed the claims made over 45.33 acres of land in survey numbers of 239 and 240 by private parties, including Cyrus Sheshiar Mistry and five others.
Justice A. Rajasheker Reddy, while dismissing the two petitions by claimants of the land worth more than `1,500 crore, ruled that the land only belongs to Hyderabad Metropolitan Development Authority (HMDA), which had conducted an auction and My Home Constructions had purchased the said land.
According to the petitioners, it was a private land, which was evident from the Munthakab that was issued in
1955 certifying that it belonged to Nawab Nusrath Jung-I.
However, the lower court, while deciding the title of lands in the petition filed in
1973, held that the schedule lands of Kokapet village were Jagir lands, which vested in the government after enactment of the Jagir Abolition Act. Aggrieved by the judgement, the case went to the Supreme Court. The apex court allowed the auction of the land and directed the successful bidder to pay the amount.
By going through the claims and contentions of the petitioners on the said land, the court on Wednesday concluded that the claimants had tried to mislead the court by suppressing facts that their claims were earlier rejected by the Supreme Court and the High Court. For this misconduct, the court slapped `1 lakh fine on each of the six petitioners and directed them to pay the costs to Telangana State Legal Services Authority.
