REGISTER LAND IN HAFEEZPET, HC ORDERS TS

The Telangana High Court has imposed costs on the Telangana state government, Ranga Reddy district collector and sub-registrar-cumtahsild­har of Serilingam­pally mandal for refusing to register a property on Survey No. 78 of Hafeezpet village and directing that the land be registered in the name of the petitioner company within 10 days of the fee being paid. The court found fault with the government for continuing to claim that over 250 acres of land in survey number 78 belonged to it.

The Telangana High Court has imposed costs on the Telangana state government, Ranga Reddy district collector and sub-registrar-cumtahsild­har of Serilingam­pally mandal for refusing to register a property on Survey No. 78 of Hafeezpet village and directing that the land be registered in the name of the petitioner company within 10 days of the fee being paid.

The court found fault with the state government for continuing to claim that over 250 acres of land in survey number 78 belonged to it, even though on seven occasions, the Supreme Court has rejected claims of the government on the title of property in Hafeezpet village.

“When the apex court’s final decree on the case is clearly against Telangana state, the government has no business in including the land in survey number 78 of Hafeezpet village in Prohibitor­y List notified under Section 22A of the Registrati­on Act, 1908. Sub-registrar-cumtahsild­har cannot refuse to receive, register and release the sale certificat­e on the land,” the Division Bench comprising Justice M. S. Ramachandr­a Rao and Justice T. Vinod Kumar stated.

The bench issued these directions on a petition filed by Kraft Alloy Private Limited challengin­g the action of sub-registrar-cumtahsild­har refusing to release the sale certificat­e pertaining to land admeasurin­g acres 8.07 guntas on the ground that the said land is included in the list published under Section 22A of the Registrati­on Act, 1908.

The company had purchased the land in an auction conducted by the Authorised Officer of M/s. SREI Equipment Finance Limited, a finance company, under provisions of “SARFAESI Act”.
