HC FAULTS HOUSING BOARDS FOR DELAY IN REGISTRATIONS
Telangana High Court has found fault with the State Housing Board and construction companies for inordinate delay in registering flats or houses in names of their respective buyers. The court ordered the housing board, Manjeera Trinity Homes at Kukatpally village in Balanagar mandal of Hyderabad, and Ramky Enclave near Railway Station in Warangal to register properties in the names of their buyers.
Manjeera Constructions and Ramky Developers have been ordered to initiate expeditious steps registering respective flats, preferably within one week from receipt of the court’s order copy.
Telangana Housing Board is owner of the land measuring
32.69 acres at Warangal in Girmajipet and Laxmipura villages. The land was given to Ramky Developers for constructing dwelling units. Similarly, the housing board is also owner of the land at Kukatpally, which had been given for development to Manjeera Constructions.
Counsel for petitioners Arkut Chandrashekar submitted before the court that petitioners had made an agreement with the Housing Board and construction companies and paid the total sale consideration for respective flats or villas in the said cites. Though the amount was paid three years ago, Housing Board has not yet executed sale deeds in favour of petitioners, which is illegal and arbitrary, the counsel maintained.
Taking all aspects into consideration, Justice T. Amarnath Goud directed Telangana Housing Board to register the said flats or villas in favour of respective petitioners. The judge also ordered that Housing Board pay
`10,000 to each of the petitioners for the delay caused in registrations.
