TWO-WHEELER FIRM DIRECTED TO REPLACE USER’S FAULTY BIKE

The Hyderabad District Consumer Disputes Redressal Commission-i directed Honda Motorcycle and Scooter India Private Limited to replace a faulty bike sold to a customer in February 2017 through its dealer Aadi Motors Private Limited.

The direction was issued on a petition filed by one Ravindra Babu, advocate and resident of P&T Colony in Dilsukhnag­ar, who had purchased a Honda CB Shine SP motorcycle from the dealer for `85,000. The sale also included a one-year warranty. In his petition, Babu said that from the start, the handle of the motorcycle was wobbling and the wheel and shock absorbers were defective, as they were not able to sustain the road shocks and friction.

“Even after the first servicing, the problem was not rectified, and the vehicle was handed over to the service station on the advice of their technical manager for necessary repairs. The authorised service station replaced the shock absorbers with new one stating that the original was having manufactur­ing defect, and that the same was covered under the warranty,” the petition stated.

The management of Aadi Motors Private Limited contended that there was no manufactur­ing defect nor was there proof of the first service. It also contended that the customer would have returned the vehicle within a month of the purchase, if such issues existed. The dealer offered to replace the vehicle with a new one of the same make, on surrenderi­ng the one in use. The commission directed the motorcycle company and its dealer to replace the vehicle within 45 days.
