Petition filed in top court against ‘Aadhaar for bail’ in Chhattisga­rh

RAIPUR: Challengin­g the Ch hat tisgarh high court’ s order that has made the Aadhaar card mandatory for bail while examining papers submitted by an accused, a special leave petition (SLP) has been filed in the Supreme Court in which a hearing is scheduled on January 25.

The high court passed the order in the first week of January in order to curb the ram pant submission of forged documents for bail. It further said that the release warrant will be issued only after proper verificati­on of the identity of the accused and the surety he/she provides.

The concerned administra­tive staff and police officers will cooperate in the verificati­on process, the order said. It also mentioned that if it is found that a document has been provided as surety in multiple cases over the same property, it should be rejected.

Piyush Bhatiya , in his petition, contended there are many prisoners who do not have an A ad ha ar card and, the order violates their right to securing bail.

“The hearing on SLP is scheduled on January 25,” he said.

A high court lawyer, Satish Verma said, “This order is creating a problem due to the verificati­on process. I believe there should be measures that verificati­on of Aadhaar card could be done as soon as an accused files a bail petition so that it does not violate the order of Supreme Court.” HTC
