HC asks Gurgaon CJM to probe ‘torture’ of youth
CHANDIGARH: ThePunjabandHaryanahighcourt(HC) onMonday directed Gurgaon chief judicial magistrate (CJM) to look into the complaint of police torture by Gurgaon youth, Balwant Kataria alias Bobby Kataria.
The HC acted on the petition of Kataria in which he had alleged that he has been tortured and has been inflicted injuries which may not be apparent but are available to be seen through MRI examination.
Kataria faces at least six cases of criminal intimidation of policemen and others in Gurgaon and Faridabad. In January, Gurgaon police had booked Kataria for alleged abuse of policemen. In another incident, the Faridabad police had booked him for extortion and stalking a local woman in December.
His counsel Rajvinder Singh Bains had submitted that Kataria is in police remand for nearly 30 days. “The petitioner is unable to even walk as was apparent from the very sight of it when he moves,” he had said, adding that Katiaria has also not been given any legal aid.
The HC directed the CJM to look into the allegations and ensure that a competent legal aid counsel is provided to him.
“The legal aid counsel, thereafter, will take steps for redressal of the grievances of the petitioner, if any, including moving appropriate application before the competent court for his medical examination, which should include the required tests which may also be an MRI, if so mandated or required,” the court said.
