PATHANKOT: The district and sessions court was informed on Wednesday that the two accused in rape and murder case of an eight-year-old nomadic girl in Kathua were capable of performing sex.

Dr Elias Sharma, head of the department of Urology at Super Specialty Hospital, Jammu, who had conducted the medical tests of both accused Parvesh Kumar and a juvenile, informed the court of district and sessions judge Tejwinder Singh that the test reports have revealed that both the accused were capable of performing sex.

Special public prosecutor SS Basra claimed that in the cases of rape a potency test is done to ascertain the sexual potency of a person and to know that whether a person is capable to commit intercourse or not.

The defence counsel also cross examined the doctor who is also a prosecution witness.

Parvesh Kumar aka Manu is lodged in Gurdaspur Central Jail, while the juvenile is facing a trail in Kathua and is lodged at the same place.

The medical test of Parvesh was conducted on March 15, while the juvenile’s medical test was held on February 3 this year.

The trial of the case was assigned to the district and sessions court in Pathankot by the Supreme Court earlier this year after the victim’s family approached with a plea to transfer the case from Kathua.

A minor was allegedly kidnapped on January 10 and her body was found in the same area a week later. It is alleged that the minor was gangraped and later murdered.

The crime branch has arrested eight people, including a juvenile in the case.

THE TRIAL OF THE CASE WAS ASSIGNED TO THE PATHANKOT COURT BY THE SUPREME COURT EARLIER THIS YEAR AFTER THE VICTIM’S FAMILY APPROACHED IT FOR TRANSFERRING THE CASE FROM KATHUA
