Ryan murder: CBI says fingerprints of juvenile crucial

GURGAON: The application filed by the Central Bureau of Investigation (CBI) seeking directions from Juvenile Justice Board (JJB) allowing them to obtain fingerprints of the accused juvenile was taken up for hearing by the board on Friday.
The CBI vehemently argued that obtaining fingerprints is the obligation of the agency in furtherance of the investigation authority under criminal investigations whereas the defence opposed it contending that CBI had taken the juvenile accused to Ryan International School, Bhondsi where some “misconceived crime scene recreation” was carried out by the agency.
Principal magistrate Davender Singh reserved the orders for Wednesday on all the arguments and applications.
Another application filed by the juvenile’s lawyer levelling allegations against CBI regarding interrogation of the juvenile beyond designated timings were withdrawn on Friday.
“The boy was asked to walk into the bathroom, stand behind a crouched officer and hold a spoon against the neck of the officer. During the entire activity, incidentally or otherwise, the boy touched various portions of the bathroom and surroundings with his hands, in pursuance of which finger impressions are bound to be embossed and can be used by the CBI for framing the child,” said Sandeep Aneja, lawyer of the juvenile accused who the CBI had apprehended November 7.
“The CBI should have taken fingerprints earlier during his three-day custody. We have argued on all the applications regarding the supply of documents, fingerprints and the orders are reserved on all for Friday,” said Aneja.
Sushil Tekriwal, counsel of Barun Chandra Thakur, father of victim Pradhyumn Thakur who was killed in school toilet on September 8, seconded the argument of the CBI that the matter pertaining to fingerprints should be allowed for efficient and effective investigation into the crime and for bringing criminals to justice.
The juvenile’s counsel filed another application requesting the board to pass prohibitory orders from using the name of the juvenile by the CBI in their documents and otherwise.
