Three new states, Haryana among non-compliant units

THE NONCOMPLIA­NT STATES HAVE TO FURNISH A COMPLIANCE CERTIFICAT­E, IN THE FORMAT PRESCRIBED BY THE COA, WITHIN 7 DAYS

MUMBAI: Three new state associatio­ns from Northeast — Meghalaya, Nagaland and Arunachal, along with BCCI acting treasurer Anirudh Chaudhry’s Haryana and former BCCI president Anurag Thakur’s Himachal Pradesh have failed to file a compliance certificat­e and have been declared non-compliant states, according to the 10th status report filed by the Committee of Administra­tors (COA). In all, there are seven state associatio­ns declared as non-compliant. Gujarat and Karnataka are the others among the seven.

The non-compliant states have to furnish a compliance certificat­e, in the format prescribed by the COA, within seven days, failing which their right to vote at the General Body meetings of the BCCI shall stand suspended and further action will be initiated against them.

“Some state associatio­ns have failed and neglected to file a compliance certificat­e. These state associatio­ns are clearly in breach of the judgment and have been classified as non-compliant state associatio­ns,” stated COA in its status report.

Most state associatio­ns have furnished a compliance certificat­e along with their amended constituti­on. However, on scrutiny, the COA has found 10 of them partially compliant with the judgment and put them in category B which includes acting secretary’s Jharkhand, Maharashtr­a, Tamil Nadu, Vidarbha and Bengal. The remaining states, where the COA found they have made some material deviations from the BCCI Constituti­on, have been classified as substantia­lly compliant state associatio­ns (category C). The 17 in this list include Delhi, Mumbai, Hyderabad and UP. The COA has asked the Court for further directions in order to secure compliance from the errant state associatio­ns.

While asking for the appointmen­t of an Ombudsman and an Ethics Officer in the BCCI, the COA has stated that first the elections in the state associatio­ns will be held after which the BCCI AGM under the new constituti­on will take place. They have asked for directions for holding the BCCI elections within 90 days.

NEW BENCH

On Tuesday, a new Supreme Court bench of Justice SA Bobde and Justice Abhay Manohar Sapre is likely to decide whether the COA will continue to function as a two-member body.
