HRERA issues show-cause notices to 10 builders for violation of norms

CHANDIGARH With a view to making builders accountabl­e to the law, the (HRERA) has issued show cause notices to 10 top builders in Gurugram for violating the provisions of the Real Estate (Regulatory and Developmen­t) Act 2016.

HRERA has issued notices to Raheja Developers Ltd, Godrej Properties, TATA Housing Developers Pvt Ltd, Eldeco Sohna Projects Ltd, Mapsko Builders Pvt Ltd, Supertech Projects, Gold Souk Infrastruc­ture Pvt Ltd, Identity Buildtech Pvt & Others, St Patricks Realty Pvt Ltd and Central Park, for advertisin­g about residentia­l projects that have not been registered with it.

All the builders have been accused of violating the Section 3(1) of the Act.

Under the section, no builder can advertise, market, book, sell or offer for sale, or invite persons to purchasean­y plot, apartment or building in any real estate project or part of it, in any planning area, without registerin­g the project with the Real Estate (Regulation and Developmen­t) Act.

The HRERA issued notices to the builders after it came to its notice that advertisem­ents of the unregister­ed projects appeared in the Delhi editions of the two national newspapers. Most of these projects are in Gurugram. The notice states that as per the HRERA office record, builders have not registered the said projects with it before giving the advertisem­ent in the newspaper.

“Consequent­ly, published advertisem­ent on your behalf is a punishable offence under the provisions of the Section 59 (1) of the Act,” states the notice sent to the builders.

The builders have been given 15 days to explain why a legal action should not be initiated against them under the provisions of the Act.

If found guilty for violation of the Act, specifical­ly Section 3(1), builders will be liable to a penalty which may extend up to 10% of the estimated cost of the real estate project, as determined by the HRERA.

Under the RERA Act, all builders and projects have to register themselves with state real estate regulatory authority.

These projects include new launches, ongoing and incomplete projects.

In Haryana, even though the final rules made under the Act provisions are still to be notified, builders can register their projects with the interim HRERA.

The HRERA has received more than a dozen applicatio­ns for registrati­on so far, and has started giving registrati­on numbers to builder projects.

The interim HRERA has formulated the rules and has submitted these with the state government for its final approval. The final rules are expected to be notified by the end of this month.
