CM ASKS HOME DEPT TO EXAMINE, IMPLEMENT RECOMMENDATIONS OF JUSTICE GILL PANEL ON CASES LODGED DURING BJPSAD REGIME
CHANDIGARH :Chief minister Captain Amarinder Singh directed the state home and judicial department to examine and implement the recommendations of the Justice Gill Commission regarding “false and politically motivated” cases lodged during the previous BJP-SAD regime in a time-bound manner.
The CM, who received the interim report from Justice Mehtab Singh Gill (retd) on Wednesday, directed the commission to monitor the implementation of the report, with the help of secretary home and director prosecution. Constituted by Amarinder on April 5, the commission of Inquiry, in its interim report, has examined 179 cases of the total 4,200 complaints received till July 1, the deadline set by the commission to raised objections.
“After thorough examination of 79 cases, it was found that the enforcement department of the Government of India had correctly and impartially concluded the cases to be false. In another 19 cases, the commission has recommended cancellation of FIR/ withdrawal of case against the accused, and has recommended that the home and judicial department should make a request to courts to cancel FIRs,” Gill told the media after submitting the report to the CM.
The commission also recommended that in cases where the court has accepted the cancellation report, the complainant should be prosecuted under Sections 182 (false information, with intent to cause public servant to use his lawful power to the injury of another person) of the Indian penal Code except in cross cases.
“Prosecution was necessary to check registration of false cases and save honest and innocent citizens from harassment,” said justice Gill. In the remaining cases, the panel has recommended prosecution of the complainant suggesting that adequate compensation be recovered from the investigating officer. In some cases, Gill has recommended action against police officials responsible for instigating the false case, calling for dismissal of the officers, including at the DSP level.
Gill said the government should ensure that police officials with integrity are given key posts. The panel was mandated to conduct probe into cases in which a final report under Section 173 of the Code of Criminal Procedure (CrPC) had not been presented so far.
