Consumer forum slaps fine on Blue Dart
THE COMPANY HAS ALSO BEEN ASKED TO PAY COMPENSATION TO THE COMPLAINANT
JALANDHAR:HOLDING the company responsible for stolen goods from a parcel, the district consumer disputes redressal forum on Thursday directed the Blue Dart Express Limited to refund the value of the goods worth ₹1, 02,975 with 12% per annum interest from the date of booking June 10, 2015, till realisation.
The company has also been asked to pay compensation to the complainant, to the tune of ₹20,000, including ₹5,000 as litigation expenses for mental agony and harassment caused to the customer as the company lost his goods while delivering to Lucknow. Jitin Mahajan, partner of Pooja Enterprises has filed a complaint before the forum alleging that he had booked a consignment of 100 pieces of hockey sticks valued ₹1.02 lakh on June 10, 2015, which was to be delivered to M/s Sports Line, 35, Lucknow Plaza, Nazirabad Road, Lucknow, before June15.
He had paid ₹1,029 that included freight and insurance charges. The company, however, failed to deliver the goods till June 23, and on June 26, they sent him a mail that goods will be delivered soon but failed to do so.
The complainant said, a few days later, he was intimated by the company that the company’s vehicle was robbed by some miscreants on the way near Shikohabad, in Firozabad district of UP.
The company refused to give him the claim and failed to return the goods. Upon the notice, the representative of company pleaded that complainant failed to get insured the consignment in question and they are not liable to pay the compensation. The forum observed that a bill’s copy proved that 100 pieces of hockey sticks were purchased and was booked to deliver through the company. The forum order stated that company has not taken any plea that the robbery incident was beyond the control of the company’s employee and they have done their job with due diligence.
