WHAT’S NEXT FOR…
ALOK VERMA:
He’s back, but conditionally (he can’t take major decisions), and much depends on the selection committee clearing him of all charges. If that happens, he may approach the court again seeking an extension equal to the time he has lost on account of being divested of his powers. He is to retire January 31
CBI:
The uncertainty continues. Much like under interim director Nageshwar Rao, the agency will not be able to launch new investigations and take major policy decisions
RAFALE:
Verma is unlikely to launch a preliminary probe because the SC has found nothing wrong with the deal and launching a case may be seen as a “policy decision”. It will require the government’s approval
RAKESH ASTHANA:
He remains in limbo, although the government could now withdraw its earlier order and reinstate him at CBI. The investigation against him in CBI is likely to pick up steam
THE SELECTION COMMITTEE:
Leader of the largest opposition party in the Lok Sabha, a week’s time to study the report of a probe against Verma and decide on his continuation.
“The transfer of the director without the consent of the selection committee negates the legislative intent that is to ensure independence of CBI,” said the judgment, which was read out by justice Kaul as CJI Gogoi, who authored the order, was on leave.
“Within a week, the selection committee, led by the PM, will meet and look into the aspect of whether Verma needs to be removed or not,” said the bench.
The
panel headed by the PM could clear
Verma, find substance in the charges against him, seek a deeper investigation, or simply not arrive at a decision till he retires
