Did builder sell 40 flats to 80 buyers?

firm Assotech Limited has allegedly sold flats to multiple buyers in its Windsor Court housing project located in Noida Sector 78, which the developer has attributed to an error.

As many as 40 flats have been allegedly sold out to 80 persons -one flat per two persons.

Assotech Limited managing director Sanjeev Shrivastva said an error committed by his staff caused this anomaly.

“I bought a flat for ₹45 lakh in Windsor Court in 2012 and took loan from a bank. After some time, I got to know that someone else also took a loan on my flat. When I took the matter to the builder, he assured he would sort it out. But to date, the builder has not resolved my issues,” said Pushkar Gupta, a teacher.

Gupta said he had borrowed money for the down payment from his retired father. “I never thought a builder like Assotech Limited will cheat me and 39 others in this manner. I have been running from pillar to post, taking off from my work to get justice. But nothing happened,” said Gupta.

Assotech Limited is developing 709 dwelling units in the sixtower project. The builder had launched the project in 2009-10 with a promise to deliver in 2013.

But the builder is yet to complete the project. Around 60 families have moved into the unfinished towers.

Buyers have filed cases against the builder in court and with the economic offences wing, demanding justice in the case where 40 flats were allegedly sold to 80 persons.

“When I realised someone else had also obtained a loan against my flat, initially I did not believe it. When I questioned the builder Sanjeev Shrivastva, he assured me of help. I met him multiple times but he is yet to resolve my problem and I am feeling cheated,” said Avneet Uppal, another buyer.

The Noida authority has promised to look into the matter. “We will help homebuyers,” said Manish Verma, additional chief executive officer of the Noida authority.

The builder said his staff is to be blamed for this anomaly.

“Homebuyers should not panic at all because I have not committed any irregulari­ty. I have sold 40 flats to 40 people. But my staff took constructi­on loans against these flats from a financial institutio­n. I will pay the dues to the bank and the 40 buyers will not have to trouble at all. I will address the issue soon. The matter is pending in court and also before EOW. I will explain everything to court and it will be solved,” said Shrivastva.
