Fortis death: Hospital named in FIR for not reporting dengue case
GURGAON: The Special investigation team (SIT) of Gurgaon police, which is investigating the dengue death and subsequent overcharging from the parents of a 7-year-old girl, who died at Fortis, Gurgaon, has decided to add Section 188 of the IPC against the hospital administration.
This comes after a meeting of senior police officials with health department officials.
The inclusion of Section 188 against the hospital comes after the health hub failed to inform that a dengue patient had been admitted in the institute, which is mandatory.
The new section attracts imprisonment up to six month or a fine up to Rs 1,000 or both.
Last Saturday, the Haryana health department had submitted a complaint against the concerned doctor of Fortis hospital after which a case registered under Section 304(2) (culpable homicide not amounting to murder) of the Indian Penal Code (IPC) at Sushant Lok police station for the death of the 7-year-old girl, Adya Singh.
“After looking into the report and other aspects of the case, it was decided to add section 188 of the IPC ,” said Ravinder Kumar, PRO, Gurgaon police. The move comes after the father of the victim Jayant Singh, a resident of Dwarka had demanded strict action against the hospital for negligence.
The matter has been highlighted by both the Haryana government as well as Punjab and Haryana High Court.
The court has asked the government to submit a report by December 18 and also questioned why the case was filed against a doctor and not the hospital.
Health minister Anil Vij had said that criminal sections in the FIR would be added on the basis of irregularities found in the investigation report.
A spokesperson of Fortis Hospital said: “We have not received any official communication in this regard”.
