Delhi Flying Club moves HC to restrain Centre from taking over

NEWDELHI: The Delhi Flying Club has moved the Delhi High court, seeking to restrain the Centre from taking possession of the club or creating any hindrance in its operation, saying the erstwhile executive committee had allegedly surrendere­d its legal rights and gave an undertakin­g to vacate the club.

The plea, filed through advocate Umesh Sharma and advocate Ajay Kumar, sought to constitute an Appellate Tribunal of Airport to hear and decide the appeal filed by the Delhi Flying Club in March, 2018, against the court orders on January 6, 2017, in the eviction case.

The petition was filed by the newly-elected executive committee of the club as the erstwhile executive committee had misconduct­ed itself by surrenderi­ng its valuable legal rights and made an undertakin­g to vacate the historic club without seeking legal remedies.

It said the erstwhile management committee of the club — for some extraneous and dishonest intentions — had kept all the members of the club in the dark about the status of the matter and all of sudden decided to vacate the club in a malafide manner, affecting the rights of all the members.

“The erstwhile management committee of the club has grossly mishandled the dispute with the Airports Authority of India and has kept the members in complete dark about the same and has taken a U-turn on the issue of payment of the licence fees, as a result of which the operations of the historic club will be closed,” the plea said.

The plea said that after coming to know about the conduct of the erstwhile committee, it was removed in an urgent and extraordin­ary AGM following which they moved to the court seeking the withdrawal of the statements made before the court and seek the legal remedies under law.

The high court had earlier ordered to de-seal the premises after the counsel for the club had offered to vacate it and given an undertakin­g to the court.
