NOIDA: An FIR has been registered against the managing director of Jaypee Group and two officials of the maintenance company employed at Jaypee Klassic, a part of the Jaypee Wishtown project in Sector 134, after an eight-year-old boy fell 25 feet into an under-construction shaft of the basement on Monday evening.

A complaint was filed by the residents of the society on Monday night, following which an FIR was registered under sections 288 (negligent conduct), 336 (endangering life), 337 (causing hurt) and 338 (causing grievous hurt) of the Indian Penal Code.

Police said that they are looking into the matter. “This is a technical case. We are investigating as to who was at fault and whether there was any negligence on the part of the management. We are questioning everyone. However, it will take some time to get to the bottom of the matter,” Hans Raj Bhadoriya, station house officer, Expressway police station, said.

Around 7pm on Monday, Aarav Beniwal fell almost 25 feet into the shaft. He was rescued by the fire department personnel and taken to the nearby Jaypee hospital in Sector 128, where he is currently undergoing treatment.

Aarav is a class 3 student of JBM Global School, Sector 132. The boy’s father Yashpal Beniwal works with tech group HCL and his mother is a homemaker.

According to hospital authorities, the boy continues to be criti- cal. “He has fractured both hands. His skull is also fractured. He has not regained consciousness and continues to be in the intensive care unit,” a spokesperson of the hospital said.

The maintenance office has denied any negligence on its part. “We had instructed residents to not allow children to play in the part of the park near the basement shaft. There was only a thin wall, which might have become weak over time. However, what led to the collapse of the wall will come out in the investigation,” a maintenance official said.

The Jaypee Group in a statement said, “We are in constant touch with the child’s parents and are ensuring the best medical care for him. Safety and quality has been a hallmark of the Jaypee Group and we will ensure that no such incident is repeated.”
