‘File FIR against 7 builders if flats not registered in a week’

NOIDA: Gautam Budh Nagar district magistrate on Tuesday directed the stamp and registrati­on department to file an FIR against seven builders if they fail to get flats registry executed as per law in a week’s time.

DM BN Singh’s order came after the DM learnt that seven builders — Amrapali Group, Divine India Private Limited, Assotech, Victory Cross Road, Realtors Private Limited, AGC Ajnara Homes and Gardenia Aims Glory have given possession to buyers without obtaining occupancy certificat­e from the Noida authority.

The administra­tion officials along with the stamp and registrati­on staff also took a meeting with the builders and directed them not to give possession of the flats without registry execution with the respective buyers. The DM took this step because the UP government is losing revenue due to non-registry of the flats.

“Since the seven builders have offered possession to 10,318 homebuyers without execution of registry, the state government has lost revenue of ₹334.13 crore. Under section 64 of the UP Stamp Act, the stamp and registrati­on department should file an FIR against the builders. The FIR will be filed after sending a week’s notice to the builders,” Singh said.

The DM also directed the stamp and registrati­on department to conduct inspection at the housing projects, where the buyers have shifted into flats without execution of registry.

“The stamp and registrati­on team will also inspect to verify that if the builders have offered possession to buyers without the Noida Authority issuing them occupancy certificat­e as per law. The builders must also ensure that they offer possession to buyers only after developing adequate common facilities such as sewage connection, drinking water supply, community centre, lift, etc,” said Singh.

According to Section 13 of the UP Apartment (promotion of constructi­on ownership and maintenanc­e) Act, 2010, a builder cannot allow possession or transfer of ownership right without executing the registrati­on of the flat.

The stamp and registrati­on department had on January 21 started issuing notices to the builders.
