Aadhaar to love jihad: Key cases in SC

NEWDELHI: Monday is all set to be a day of significan­t judicial importance with a number of high-profile cases, ranging from opposition to Aadhaar linking to the Kerala ‘love jihad’ case, scheduled to be taken up by the Supreme Court.

AADHAAR CHALLENGE

The West Bengal government’s petition against the Centre’s move to make Aadhaar mandatory for availing benefits under social welfare schemes will be heard by a Justice AK Sikri-led bench. The Centre is also expected to inform the top court if it will extend the deadline for mandatory linking of Aadhaar to receive benefits till March 31 for everyone. On 25 October, attorney general KK Venugopal had submitted before the court that the extension will be for only those who do not have Aadhaar.

The apex court is also scheduled to hear a plea challengin­g the linking of the 12-digit unique ID number with mobile phones.

ARTICLE 35A

A CJI-led bench will take up petitions contesting that Article 35A, relating to special rights and privileges of the Jammu and Kashmir legislatur­e, was in violation of the Constituti­on.The main petition in the case is filed by the NGO ‘We the Citizens’, which has argued that the state’s special autonomous status under Articles 35A and 370, was discrimina­tory against non-J&K residents when it came to getting government jobs and purchasing real estate.

KERALA’S ‘LOVE JIHAD’

The case relating to annulment of marriage between a Muslim man and a Hindu woman, who converted to Islam, would come up before the CJi’s bench.

During the last hearing in the case, CJI Misra had questioned the HC order that declared the marriage invalid.

REFORMS IN BCCI

A special bench led by CJI Misra will assemble to take up the case related to reforms in the BCCI.

On the top court’s direction, the office bearers of BCCI had submitted a draft constituti­on to the Committee of Administra­tors (COA), which in turn filed a report before the SC on Friday.

The SC is likely to take up the COA’s report on Monday and pass necessary directions.

SAFETY IN SCHOOLS

The CJI-led bench will also hear petitions demanding safety standards for private schools. The cases were filed pursuant to the murder of an 8-year-old boy in Gurgaon’s Ryan Internatio­nal school in September.

SANJAY CHANDRA BAIL

In response to an apex court query, Unitech promoter Sanjay Chandra, who was jailed in a cheating case, has to inform SC when would he deposit ₹1,000 crore to secure his bail.
