Prima facie evidence enough to prosecute Yasin Malik: Court

JAMMU: A TADA court on Saturday said there was enough primafacie evidence to prosecute separatist leader Yasin Malik for his involvemen­t in the killing of four Indian Air Force (IAF) personnel in Kashmir in 1990.

The next date of hearing is March 16.

Malik, the founder of Jammu Kashmir Liberation Front (JKLF), a banned outfit, is currently under trial for the alleged killing of four IAF personnel and kidnapping of Rubaiyya Sayeed, the daughter of then home minister Mufti Mohammed Sayeed in 1989-90.

He is presently lodged at the Tihar Jail in New Delhi.

Besides Malik, there are six other accused in the case.

Special public prosecutor of the CBI, advocate Pavittar Singh Bhardwaj said, “The court found enough prima facie evidences against the accused. The court announced that primarily offences under Section 302 of the Indian Penal Code, 120-B of the Arms Act and other sections of

TADA Act are made out against them from the documents.”

Bhardwaj said, “All the accused were not present before the court. Two could not come from Srinagar because the highway was closed and their fathers were also ill. Now, they will be brought here to put signatures and charges will be read out to them. Thereafter, evidence will be initiated against the accused.”

He said the charges have to be sent to Yasin Malik in Tihar Jail, who has to put his signature before a court and Showkat Bakshi, another accused lodged in a prison outside J&K.

In October last year, the separatist leader was scheduled to appear in the TADA court in Jammu. However, Tihar Jail authoritie­s refused to produce him before the court.
