SC orders inspection of Supertech towers
Top court hearing realty firm’s appeal against demolition of its Emerald Court twin towers in Noida, directed the National Building Construction Corporation to inspect the structures and submit a report in four weeks
The Supreme Court has ordered the National Building Construction Corporation (NBCC) to inspect the twin towers of Supertech’s Emerald Court in Noida and submit a report .
The two buildings were ordered to be demolished by the Allahabad High Court for violation of norms.
Hearing Supertech’s petition against an Allahabad High Court’s order, a bench of Justice Dipak Misra and Justice RF Nariman said the realty firm has to refund money to those purchasers who are no longer keen to have the flats in the two disputed buildings. “You are embroiled in an imbroglio. But why should they (flat owners) get stuck in it?” the bench asked when it came across applications filed by buyers who want their money back. The court asked Supertech to respond to the applications by August 9 and gave NBCC four weeks to submit its inspection report on the sufficiency of distance between the two towers. Supertech informed the court it has deposited Rs 5 crore with the top court’s Registry as per its earlier order.
The SC had asked them to make the deposit as part of refund to homebuyers for the project. The bench had on the last date said the company’s appeal against the Allahabad High Court’s direction ordering demolition of the two towers will be heard only after the amount is deposited.The HC had on April 11, 2014 ordered the demolition of the two 40-storey residential twin towers -- Apex and Ceyane -- in Noida while directing Supertech to refund money to homebuyers with 14 per cent interest in three months.
